Please take note that the Youth Arise Organization may, at its sole discretion, modify or revise these Site Terms and policies at any time, and you agree to be bound by such modifications. Any modifications will be effective immediately upon posting of the revisions on the Site, and you relinquish  any right you may have to receive specific notice of such modifications. Your continued use of our site  following the posting of changes or modifications will confirm your acceptance of such changes or modifications. Our advice is for you to periodically review the Site Terms and applicable policies to understand the terms and conditions that apply to your use of the Site.

Who is subject to the terms and conditions?

Any user or visitor of this website agrees to be bound by the terms and conditions stated here. If you are using the site on behalf of another unit or organization you represent, you are authorized to accept these Site Terms on such unit or organization’s behalf, and that such unit or organization agrees to indemnify you and YAO for violations of these Terms.

 Prohibitions

This Site’s overall “look and feel” ;its logo and all designs, text, graphics, pictures, information, data, software, sound files, other files and the selection and arrangement thereof are owned by or licensed to YAO’s and are protected by copyright, trademark and other intellectual property rights under the law

No Commercial Activity; Third-Party Products and Services

This Site is solely for furthering the nonprofit purposes of Youth Arise Organization. No advertisements or promotions of a commercial nature for products or services are permitted on the Site and you agree not to post such content.

Copyright

Youth Arise Organization permits you  to access and use the site materials and electronically copy, and print to hard copy portions of the Site Materials for your informational, non-commercial and personal use only.  Such permission granted is subject to these Site Terms and does not include: 

1. Any resale or commercial use of the Site Or its materials;
2. The distribution, public performance or public display of any Site Materials;
3. Modifying or otherwise making any derivative uses of the Site and the Site Materials, or any portion thereof;
4. Use of any data mining, robots, crawler, spyware, engine, device, software, extraction tool or any other automatic device, utility or manual process of any kind;
5. Downloading (other than the page caching) of any portion of the Site, the Site Materials or any information contained therein, except as expressly permitted on the Site;
6. Any use of the Site or the Site Materials other than for its intended purpose, please notify us by providing the following information in writing to our Legal Department at the address listed below.
   1. A physical or electronic signature of the owner of the allegedly infringed copyright or such owner’s authorized representative.

You grant YAO and its affiliates and sublicensees the right to use the name that you submit in connection with such content, if we choose. Restricted Behaviors

You agree that any and all billing and registration information you provide on the Site will be accurate and complete. Your provision of inaccurate or incomplete information constitutes a material breach of these terms and conditions. Without limiting the foregoing, you specifically may not:

1. Frame or utilize framing techniques to enclose any trademark or other proprietary information (including, without limitation, any images, text or page layout).
2. Engage in any activities through or in connection with this Site that seek to attempt to harm minors or are unlawful, offensive, obscene, threatening, harassing, and abusive or that violate any right of any third party.
3. Attempt to gain unauthorized access to services, materials, other accounts, computer systems or networks connected to any YAO server.
4. Attempt to use the Site for any purposes other than those intended by YAO, as determined by YAO in its sole discretion.
5. Upload or submit any data or information that contains viruses or any other computer code, corrupt files or programs designed to interrupt, destroy or limit the functionality or disrupt any software, hardware, telecommunications, networks, servers or other equipment.
6. Engage in any activity that interferes with a user’s access to this Site or the proper operation of this Site. You also agree that, in using this Site, you will not impersonate any person , unit or .

The Site includes interactive areas and services , in which you or other users create, post or store content, messages, materials, data, music, photos, video, graphics, or other items or materials on the Site . You are solely responsible for your use of such Interactive Areas and use them at your own risk. You agree not to post, upload to, transmit, distribute, store, create or otherwise publish through the Site any of the following:

7. Viruses, corrupted data or other harmful, disruptive or destructive files; and
8. User Content that, in the sole judgment of YAO’s, is objectionable or which restricts or inhibits any other person from using or enjoying the Interactive Areas or the Site, or which may expose YAO’s or its users to any harm or liability of any type.

You further agree that you are solely responsible for your conduct while on the Site and the Service, and you agree that you will not do any of the following in connection with the Site, the Service or its users:

1. Use the Site or the Service in any manner that could interfere with, disrupt, negatively affect or inhibit other users from fully enjoying the Site or that could damage, disable, overburden or impair the functioning of the Site in any manner;
2. Impersonate or post on behalf or any person or entity or otherwise misrepresent your affiliation with a person or entity;
3. Stalk, intimidate, threaten, or otherwise harass or cause discomfort to other users;

5. Use the Site or the Service for any illegal or unauthorized purpose or engage in, encourage, or promote any illegal activity, or any activity that violates these Terms of Use.

YAO’s takes no responsibility and assumes no liability for any User Content posted, stored or uploaded by you or any third party, or for any loss or damage thereto, or for any user conduct, nor is YAO’s liable for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography or profanity you may encounter. Your use of Interactive Areas is at your own risk. Enforcement of the user content or conduct rules in these Site Terms is solely at YAO’s discretion, and failure to enforce such rules in some instances does not constitute a waiver of our right to enforce the rules in other instances. In addition, these rules do not create any private right of action on the part of any third party or any reasonable expectation that the Site will not contain any content that is prohibited by such rules.

What will get a user banned?

YAO may monitor use of this Site at any and all times to determine compliance with this Terms and conditions. Please also note that if we determine you have abused or violated the letter or intent of any of these terms, conditions or guidelines, or any applicable law, we may terminate or suspend your access to the Site and all related services, initiate an investigation, remove materials from our servers, issue a warning, block any prohibited activity, and take any other responsive action. Additionally, users who violate these terms and conditions may incur criminal and/or civil liability.

Warranty.

In No Event Shall Yao, Its Board of directors, Members or senior leaders Be Liable For Any Direct, Special, Indirect Or Consequential Damages, Or Any Other Damages Of Any Kind, Including But Not Limited To Loss Of Use, Loss Of Profits Or Loss Of Data, Whether In An Action In Contract, Arising Out Of Or In Any Way Connected With The Use Of Or Inability To Use The Site, The Services, The Content Or The Materials Contained In it.

Indemnification

You agree to defend, indemnify and hold harmless YAO’s, its independent contractors, service providers and consultants, and their respective directors, employees and agents, from and against any claims, damages, costs, liabilities and expenses (including, but not limited to, reasonable attorneys’ fees) arising out of or related to any User Content you post, store or otherwise transmit on or through the Site or your use of  the Interactive Areas, including without limitation any actual or threatened suit, demand or claim made against YAO’s and/or its independent contractors, service providers, employees, directors or consultants, arising out of or relating to the User Content, your conduct, your violation of these Site Terms or your violation of the rights of any third party.
